Welcome to Cheap O Planner. Please read these Terms of Service ("Terms") carefully before using our website, mobile applications, or booking services (collectively, the "Platform"). By accessing or using our Platform, you agree to be legally bound by these Terms and our Privacy Policy.

1. Scope of Services & Intermediary Role

  • Booking Intermediary: Cheap O Planner operates strictly as a third-party marketplace. We facilitate bookings by connecting you (the "Customer") with independent travel providers, including airlines, hotels, car rental companies, and tour operators (collectively, "Travel Suppliers").

  • Separate Contracts: When you make a booking, you enter into a direct, legally binding contract with the specific Travel Supplier. Cheap O Planner is not a party to that contract, nor are we a co-vendor of the travel services.

  • Supplier Dominance: All rights, remedies, cancellations, and operational rules are governed entirely by the individual Travel Supplier's specific terms and conditions.

2. User Accounts & Booking Accuracy

  • Account Security: If you create an account, you are entirely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

  • Legal Name Matches: You must ensure that all passenger names, dates of birth, and passport numbers entered during booking exactly match the government-issued photo identification used for travel. Cheap O Planner is not liable for boarding rejections or name-change fees resulting from customer input errors.

  • Age Requirements: You must be at least 18 years old and possess the legal authority to enter into financial agreements to use this Platform.

3. Pricing, Payments, and Agency Fees

  • Price Volatility: All travel prices, taxes, and availability listed on our Platform are supplied directly by the Travel Suppliers. Prices are subject to dynamic real-time updates and are not guaranteed until the booking transaction is completed and a confirmation voucher is issued.

  • Agency Service Fees: Cheap O Planner charges non-refundable service fees for processing transactions and providing customer support. These agency fees are completely separate from the ticket or room costs set by the Travel Suppliers.

  • Local Taxes & On-Site Fees: Certain destinations, hotels, or airports impose mandatory local fees (e.g., resort fees, city tourist taxes, baggage fees) that must be paid directly on-site to the Supplier. These are not included in your prepaid Platform booking unless explicitly stated.

4. Cancellations, Modifications, and Refunds

  • Supplier Restrictions: Many airline tickets, promotional hotel rooms, and vacation packages are strictly non-refundable, non-changeable, or non-transferable according to Supplier rules.

  • No Show Policy: If you fail to show up for the first segment of a multi-stop flight itinerary, the airline will automatically cancel all remaining segments without a refund. The same applies to hotel check-ins.

  • Agency Processing Window: When a change or cancellation is permitted by the Supplier, Cheap O Planner may charge an administrative fee to process the modification on top of any fees levied directly by the Travel Supplier.

5. Passports, Visas, and Health Requirements

  • Customer Responsibility: It is your sole responsibility to research, obtain, and carry valid passports, entry visas, transit visas, and health vaccinations required by the destination and transit countries.

  • No Liability for Rejection: Cheap O Planner accepts zero liability if you are denied boarding, entry, or transit by any airline or government border authority due to improper documentation.

6. Limitation of Liability & Indemnification

  • No Operational Control: Cheap O Planner is not liable for any personal injury, property damage, financial loss, death, delay, inconvenience, or irregularities caused by the actions, errors, omissions, bankruptcies, or defaults of any Travel Supplier.

  • Force Majeure: We are not responsible for any disruptions, cancellations, or losses caused by events beyond our reasonable control, including but not limited to acts of God, war, strikes, government entry restrictions, weather anomalies, pandemics, or airport closures.

  • Maximum Liability: To the maximum extent permitted by applicable law, our total liability for any claim arising out of your use of our Platform shall not exceed the total amount of service fees you paid directly to Cheap O Planner for the specific booking in question.

7. Intellectual Property & Brand Assets

  • Platform Content: All text, software, code, layout designs, and graphics unique to the Platform are the exclusive intellectual property of Cheap O Planner.

  • Third-Party Marks: All airline, hotel, and car rental names, logos, or trademarks displayed on our Platform are the property of their respective owners. They are used purely as informational, nominative reference tools to identify travel choices for the user, in accordance with fair-use and advertising regulations.

Section 8: Governing Law, Jurisdiction, and Class Action Waiver

  • Governing Law (United States): For users residing in the United States, these Terms and any disputes arising out of them shall be governed by the laws of the State of Delaware And Toronto, without regard to its conflict of law provisions. Any legal action must be brought exclusively in the federal or state courts located in that jurisdiction.

  • Governing Law (Canada): For users residing in Canada, these Terms are governed by the laws of the Province of Delaware And Toronto and the federal laws of Canada applicable therein.

  • US/CA Mutual Waiver of Class Actions: You and [Your Agency Name] agree that any dispute resolution proceedings will be conducted strictly on an individual basis and not in a class, consolidated, or representative action. You expressly waive your right to file or participate in a class-action lawsuit against this agency in both US and Canadian courts.
